In South Carolina, before a Magistrate Judge can issue an arrest warrant, he must have an affidavit that sets forth facts to support probable cause. If the affidavit only contains conclusions or allegations that are not supported with facts, the Magistrate should not issue a warrant. However, if the Magistrate determines from the affidavit that there are sufficient facts to believe that the suspect has committed a crime, he may then issue a warrant for his arrest. Searching for these active warrants in Richland County is made possible by an online case records system.
